This section defines the words used in the county's bus and paratransit rules. It explains who counts as a youth, senior, or child, what a bus pass is, and what paratransit service means. It also defines the transportation agency and its staff.

As used in this Chapter, unless the context otherwise requires:means any physical or verbal mistreatment, including hitting, kicking, gestures, yelling, spitting, threats, intimidation, assaults, slurs, and cursing and sexual harassment including unwanted touching, comments, or gestures, of a sexual nature or because of their gender, sexual orientation, gender expression, or gender identity.means an individual accompanying an eligible paratransit rider and must have the same trip origin and destination.means any person over the age of eighteen (18) years who does not qualify as a "youth."means the Transportation Agency, County of Kaua'i.means a motor vehicle designed for carrying more than ten (10) passengers and used for the transportation of persons.means a card or similar document distributed as approved by the Agency that entitles the holder to unlimited or specified rides on the County bus system, or both.means a bus pass that is valid for only the day it is being used.means a bus pass that is valid for the month of pass purchased.means a bus pass that is valid for a one-year period.means personnel employed by the County of Kaua'i Transportation Agency (CTA) exclusively or predominantly for the operation and maintenance of the County bus system.means any person six (6) years of age or younger.means the public mass transit service provided by the County through the use of buses. The term includes:means transit service provided on a fixed schedule along a prescribed route to include:means a primary transit route that travels over long distances.means a transit route that travels 1n a small geographic area.means any system of transporting individuals, including the provision of designated public transportation service by public entities, including, but not limited to, specified public transportation service, which is not a fixed route system.shall have the same meaning ascribed to that term m 49 CFR Section 37.3, as the same may from time to time be amended.means Executive on Transportation of the Transportation Agency, under the Mayor's Office, County of Kaua'i, or his/her duly authorized representative.means all or any portion of buildings, structures. sites, complexes, equipment. roads, walkways, passageways, parking lots, or other real or personal property, including sites where the building, property, structure, or equipment is located.includes the following:Paratransit eligibility Identification Cards distributed as approved by the Agency for the duration as indicated on the card;Employee Identification Cards distributed as approved by the Agency for the duration indicated on the card;Student and generally accepted photo Identification Cards issued by respective agencies and schools as indicated on the card; andIdentification Cards for senior citizens.means any person to w horn a Medicare card has been issued, pursuant to Title II or Title XVIII of the Social Security Act, 42 U.S.C. 401, et seq. and 42 U.S.C. 1395, et seq.means the public transit service that supplements the County bus system to serve persons who are paratransit eligible according to the Americans with Disabilities Act of 1990 (ADA); CFR 49, Part 37, Subpart F, Section 37.123 or persons certified as eligible by the Agency, or both.means personnel employed by the County of Kaua'i Transportation Agency exclusively or predominantly for the operation and maintenance of the paratransit service.means a vehicle owned by the County of Kaua'i and used in the paratransit service.means a person designated or employed specifically to help a person with a disability meet personal needs and without whom the person with a disability would not be able to ride.means any individual age sixty-five (65) and over.shall have the same meaning as ascribed to that term in 49 CFR Section 37.3, as the same may from time to time be amended.means the required payment for a ride on the County bus system.includes the Agency and the entity or entities that operate the County bus system and paratransit service.means any individual from the ages of seven (7) through eighteen (18).
