The Council finds that, in order to promote the safety and welfare of those who reside and/or are serviced by certain private (non-dedicated or non-surrendered) streets and roads, it is in the public interest that the County's policy for the improvement and maintenance of certain private streets and roads be stated.The Council further finds that, in certain instances, quick emergency response time in life-threatening situations is hindered by the poor condition of certain private (non-dedicated or non-surrendered) streets and roads, which often require maintenance and/or improvement in order to improve accessibility for emergency vehicles.The purpose of this Article is to establish the policy, pursuant to Chapter 265A-1, H.R.S., as amended in 1988, under which the County may improve, grade, repair, or do any construction work on private (nondedicated or non-surrendered) streets or roads as much as possible, within the physical constraints of each such private (non-dedicated or non-surrendered) streets or roads.
