What a grading permit allows and its conditions

A grading permit only allows the work listed on it and approved plans. It does not remove your duty to get other permits. The County Engineer can add conditions to protect historic sites, prevent hazards, and manage traffic and cleanup.

The issuance of a grading permit shall constitute an authorization to do only that work described on the permit and on the plans and specifications approved by the County Engineer.Jurisdiction of Other Agencies. Permits issued under the requirements of this Article shall not relieve the owner of responsibility for securing required permits or approval for work regulated by any other code, department or division of any government agency.Conditions of Approval. In granting any permit under this Article, the County Engineer:Shall attach conditions as required by law, ordinance, rule, regulation or validly issued governmental permit or as recommended by the Historic Preservation Division of the Department of Land and Natural Resources to identify, preserve or protect historic properties and burial sites within the County of Kaua'i; andMay attach such conditions as may be reasonably necessary to prevent nuisances or hazards to public or private property, health or welfare. The conditions may include, but shall not be limited to:Improvement of any existing grading to bring it up to the standards of this Article.Requirements for fencing of excavations or fills which otherwise would be hazardous.The route of travel over public streets so as to cause the least interference with general traffic and to eliminate damage to public streets.Cleaning up the area.
