How a district creation process starts

The County Council can start creating a district on its own. If property owners want to force the process, they must submit a petition signed by at least 25% of the owners of land that would be taxed, plus a nonrefundable fee set by the Council. The Council must act within 90 days after receiving both.

Proceedings for the establishment of a district may be instituted by the Council on its own initiative.Proceedings for the establishment of a district shall be instituted by the Council after receipt by the County Clerk of the following:A petition requesting the institution of the proceedings signed by the owners of at least twenty-five percent (25%) of the land to be taxed in the proposed district; andA fee which the Council determines is necessary to compensate the County for the costs of proceedings to establish the proposed district.When required to institute proceedings, the Council shall do so within ninety (90) days after receipt of a petition and fee. The fee shall be nonrefundable, even if the Council does not establish the proposed district.
