How long hearings last and what the Council can change

This section sets time limits for a hearing about creating a special district. The hearing must finish within 30 days, but can be extended up to one year if needed. The Council can change the district's size or taxes, and can cancel the district after the hearing.

The hearing may be continued from time to time, but shall be completed within thirty (30) days; except that, if the Council finds that the complexity of the proposed district or the need for public participation requires additional time, the hearing may be continued from time to time for a period not to exceed one (1) year.The Council may eliminate proposed special improvements, lower one (1) or more categories of special tax to be levied pursuant to the rate or method of apportionment of the proposed special tax, or remove land from the proposed district. The Council may add land to the proposed district, but only upon petition of the owners of one hundred percent (100%) of the additional land.After the hearing, the Council may abandon the proposed establishment of the district or, after considering all protests and such other relevant factors (such as the general plan or development plan) as it deems appropriate, may proceed with establishing the district.
