Designation of Improvement Area

This section lets the County Council set aside part of a district as an "improvement area" to pay for specific improvements. The designation must be in the district's formation ordinance. Once designated, special taxes for those improvements apply only to that area, unless the ordinance says otherwise.

For the purpose of financing specified special improvements, the Council may designate a portion of a district as an improvement area. The designation shall be made in the ordinance of formation for the district. One (1) or more additional descriptive words may be used in the name of the proposed improvement area to indicate its geographic location. An improvement area shall be known as "Improvement Area No._____ of the County of Kaua'i Community Facilities District No._____." After the designation of an improvement area, all proceedings to levy special taxes for the financing of the specified special improvements shall apply only to the improvement area, except to the extent otherwise provided in the ordinance of formation.
