This section explains what certain words mean in this chapter. It defines who is an owner, what counts as a sidewalk, and when plants are considered weeds. These definitions apply unless the law says otherwise.

Unless otherwise expressly stated, whenever used in this chapter the following terms shall be taken to have the following meanings: "Owner" means the fee simple owner, lessee of record, administrator, administratrix, executor, executrix, receiver, trustee, property management agent, or any other individual, corporation, partnership, or association who has control or possession of privately owned real property; provided, however, that this term shall not include the owners of real property within agricultural districts whose lots exceed fifteen acres. "Sidewalk" means that portion of a street between a curbline or the pavement of a road, and the adjacent property line, including any setback area acquired by the county for road-widening purposes. "Weeds" means vegetation of such nature, which has reached such growth, and is present in such quantity, that it constitutes a substantial risk of one or more of the following hazards: 1. The vegetation, when dry, is or will be a fire hazard; 2. The vegetation is, or is naturally suited as sheltering or breeding place for rats, mice, mosquitoes, or other vermin or noxious insects; or 3. The vegetation overgrows or spreads upon or over any road, alley, path, or sidewalk owned or open to the public, to such extent as to obstruct, impede, or interfere with the safe or convenient use or maintenance thereof.
