Driveway Construction Standards and Rules

This section sets the rules for building, rebuilding, or fixing driveways in Maui County. It explains the required standards, maximum widths for different zones, and other rules like drainage and culverts. The county director enforces these rules.

A. Except as provided in this chapter, all driveways shall be constructed, reconstructed or repaired in accordance with the latest edition of the Standard Details for Public Works Construction which is incorporated by reference and made a part of this chapter, and on file in the office of the director. B. Whenever the latest edition of the Standard Details for Public Works Construction on file in the office of the director refers to residential zones, it means all residential, apartment, hotel, agriculture and farming zones. The maximum driveway width of the above mentioned zones shall be twenty-two feet. All other existing zones as of the date of adoption of the ordinance codified in this chapter could have a total width of twenty-five feet or forty percent of the property frontage on that street, whichever is greater; but in no event shall the width excluding flares of any one driveway exceed thirty-six feet in width. Maximum width of driveway in zones created after the adoption of the ordinance codified in this chapter will be set by the director at his discretion. C. Straight edges may be used in place of curve (radius), but at no time shall any part of the straight edges penetrate the driveway curve (radius). D. The director will also check the swale along the property frontage to see that the owner has not interfered with the drainage along the shoulder area. The director can order the owner to comply with the subdivision's cross-section if the drainage has been hampered directly or indirectly by any construction undertaken by the owner or because of the owner's negligence. E. Driveway construction shall comply with the standard specifications on file in the director's office. F. Culvert size and strength, as requested by the director, shall be placed in existing open ditch at no cost to the county prior to construction of the driveway. G. On "double-frontage lots," the driveway shall not be constructed on the rear lot lines. The planning commission shall determine the rear lot lines. (Ord. 2557 § 4, 1997; prior code § 21-7.9)
