When you can ask for a variance

This section says you must get a variance from the board of adjustment and appeals for situations not covered by the chapter. You can only ask for a variance if all four listed conditions are true, like unusual physical conditions and no harm to neighbors.

In situations not covered by this chapter, variances by the board of adjustment and appeals shall be required. Only in situations where the following conditions exist shall it be considered justifiable to request for a variance: A. The exception or variance desired arises from peculiar physical conditions not ordinarily found in most districts or because of the peculiarity of a business; B. The exception or variance desired is not against the interest, safety, convenience, and general welfare of the public; C. The granting of the permit for the exception or variance will not adversely affect the rights of adjacent property owners or tenants; D. The strict application of the terms of this chapter will work unnecessary hardship and practical difficulty on the property owner or tenant. (Prior code § 21-7.17)
