Director's Powers and Duties for Old Government Roads

This section gives the county director the power to fix or repave certain old government roads, but only if money is available and the road meets specific criteria. The director decides the design, materials, and whether to approve public requests. The county is not responsible for injuries or damage from these roads.

A. Subject to the availability of appropriations, the director may: 1. Construct, place and remove surface maintenance, by either remedial patching, resurfacing, or paving, for those portions of old government roads which have been determined by the director, in his discretion, to meet the criteria set forth in section 12.50.050 . 2. Grant or deny requests from the public, pursuant to section 12.50.060 , for remedial patching, resurfacing, or paving of portions of old government roads which have been determined by the director, in his discretion, to meet the criteria set forth in section 12.50.050 . B. The extent and design of any surface maintenance to be done on any old government road, or portion thereof, pursuant to this chapter, and the amount or type of materials to be used, shall be in the discretion of the director. C. The County shall not be responsible nor liable for any personal injuries or property damage arising from the design or maintenance, pursuant to this chapter, of any old government road. Notwithstanding any provision of this chapter to the contrary, the County makes no representation as to the safety or suitability of any old government road, maintained pursuant to this chapter, for public vehicular or nonvehicular transportation.
