Small building overhangs on public land are not violations

A minor encroachment of a structure on a public right-of-way shall not be considered
an encroachment or a basis for a zoning violation provided:
A.
The structure was legally constructed before July 1, 1997;
B.
If the structure is removed or substantially damaged or destroyed, the replacement
structure shall not be allowed to encroach within the public right-of-way;
C.
The responsibility for maintenance and repair of the structure shall be the responsibility
of the property owner and the property owner's successors in interest; and
D.
Liability for any claims for injury or damage to persons or property arising out of,
or in connection with, the structure shall be the responsibility of the property owner
and the property owner's successors in interest.
