For purposes of this chapter, unless it is plainly evident from the context that a different meaning is intended, certain words and phrases used in this chapter are defined as follows: "Commercial activity" means any act whereby a person receives any benefit or a promise to receive a benefit by providing goods or services to another person. "County" means the county of Maui, a political subdivision of the State of Hawaii. "Land" means any interest in property, roads, water, water courses, private ways and buildings and structures when attached to realty. "Owner" means the possessor of a fee interest in land, a tenant, lessee, occupant, or person in control of land. "Person" means an individual, corporation, trust, estate, partnership, association or any other legal entity. "Public access" means an area of land that is owned, controlled or possessed by the county that members of the public may use, park vehicles upon or traverse for the purpose of engaging in recreational activities. "Recreational activity" includes, but is not limited to, hunting, fishing, swimming, boating, camping, picnicking, hiking, pleasure driving, nature study, water skiing, and viewing or enjoying historical, archaeological, scenic or scientific sites, but excludes commercial activity.
