Special agreements for unusual industrial wastewater

No statement contained in this article shall be construed as prohibiting any special
agreement or arrangement between the department and any entity whereby an industrial
waste of unusual strength or character may be admitted to the wastewater system either
before or after pretreatment; provided, that there is no impairment of the functioning
of the wastewater system by reason of the admission of such wastewater, and no extra
costs are incurred by the department without recompense by the entity. In no case
will a special agreement waive compliance with a categorical pretreatment standard
or federal pretreatment requirement.
