Getting a search warrant when access is refused

If County officials are refused entry to a property and have good reason to believe there is a violation or need to inspect, they can ask a court for a search warrant. This section only explains when they can seek a warrant.

If the director and/or authorized County employees have been refused access to a building, structure, or property, or any part thereof, and are able to demonstrate probable cause to believe that there may be a violation of this article, or that there is need to inspect and/or sample as part of a routine inspection and sampling program of the County designed to verify compliance with this article or any permit or order issued hereunder, or to protect the overall public health, safety and welfare of the community, then the director may seek issuance of a search warrant through the circuit court of the second circuit, State of Hawaii.
