MCC §14.48.030

County must own or be taking the land before signing a construction contract

Before the county signs a construction contract, it must already own the land needed for the work, or it must have started a legal taking (condemnation) and gotten a court order letting it use the land. This is a narrow rule about when the county can sign such contracts.

No construction contract shall be executed on behalf of the county until land and other interests in real property required for performance of work under such contract have either been acquired or a condemnation action commenced to acquire same and an effective order of possession issued pursuant to either section 101-28 or 101-29 of the Hawaiʻi Revised Statutes.
