Agreement to finish subdivision improvements

A.
The owner or owners of the subdivision shall submit an agreement to the director who
shall refer the document to the corporation counsel for approval as to form and legality.
The agreement shall specify that the subdivider shall complete all improvements and
utilities to the satisfaction of the director and, if applicable, the department of
water supply, and shall provide that if the subdivider shall fail to so complete such
work or any portion thereof within the time specified or such extension of time under
specified conditions, the department and/or the department of water supply may complete
the same and recover the full cost and expense thereof from the subdivider.
B.
This agreement shall allow partial acceptance of improvements and partial release
of surety where the director is satisfied that the public interest is not prejudiced
thereby.
