A. There is established a commission to be known as the "Maui County cultural resources commission" and referred to in this chapter as the "commission." B. The commission consists of nine members appointed by the mayor with the approval of the council and must be chosen from professionals and persons with demonstrated experience in the following disciplines: architecture, history, archaeology, planning, architectural history, Hawaiian culture, and ethnic history and culture of the County. The independent nomination board must solicit lists of two or more persons recommended by community and professional organizations, such as the Maui Historical Society and the American Institute of Architects, Maui chapter, and the State office of Hawaiian affairs for consideration in making commission appointments. Commission members should have a demonstrated interest, competence, and knowledge in historic preservation. C. The majority of the commission members should be professionals or persons with demonstrated experience in the disciplines of archaeology, planning, architecture or architectural history, or Hawaiian culture or history to the extent they are available in the community. The commission must also include members from different areas of the County who possess a knowledge and interest in local history. When one of the disciplines is not professionally represented, the commission must seek, through appropriate means, the expertise of professionals in the disciplines when considering national register nominations and other actions that affect properties that are normally evaluated by a professional in such a discipline. D. Section 13-2 of the Revised Charter of the County of Maui (1983), as amended, applies to the commission. E. All appointments to the commission must ensure that the terms of the members of the commission conform to subsections C and D. No provision of this section may be deemed to extend or shorten the term of any current member of the commission. ( Ord. No. 5782 , § 2, 2025; Ord. No. 4026, § 2, 2013; Ord. 1941 § 1, 1990)
