This section explains the special meanings of words used in the water supply rules. It defines who is who, like the applicant, board, and consumer, and what things like groundwater, permits, and water meters mean. It helps everyone understand the rules the same way.

For purposes of this chapter, unless it is plainly evident from the context that a different meaning is intended, certain terms and words are defined as follows: "Applicant" means the landowner(s) or the landowner's authorized representative. "Area" means an aquifer system as defined in the plan. "Board" means the board of water supply of the County of Maui. "Building" shall have the same meaning, as defined in the Uniform Building Code, as adopted, amended, or replaced by the County. "Building permit" means the official document or certificate issued by the County authorizing the construction of any building or structure. "Commission" means the commission on water resource management of the State of Hawaiʻi. "Community plan" means the nine community plans for land uses and development within the County, as adopted by the council. "Consumer" means the person, firm, corporation, association or other entity whose name appears on the records of the department as the party responsible and liable for water service provided by the water department. "Corporation counsel" means the corporation counsel of the County. "Council" means the council of the County. "County" means the County of Maui, a political subdivision of the State of Hawaiʻi. "Department" means the department of water supply of the County. "Director" means the director of water supply of the County. "Groundwater" means any water found beneath the surface, whether in perched supply, dike confined, flowing or percolating in underground channels or streams, under artesian pressure or not, or otherwise. "Permit" means County land use permits, including, but not limited to, special use permits, conditional use permits, zoning of property, changes in the zoning of property, district boundary amendments, community plan amendments, subdivision of property, water meter and building permits. "Plan" means the water use and development plan for the County of Maui, comprised of the technical report and executive summary. "Potable water" means water that has been certified by the department of health as suitable for cooking or drinking purposes. "Project" means the use of land or the construction of a building or structure, as authorized by a permit. "State water code" means chapter 174C, Hawaiʻi Revised Statutes. "Structure" shall have the same meaning as defined in title 18 , subdivisions, of this code. "Surface water" means both contained surface water, that is, water upon the surface of the earth in bounds created naturally or artificially, including, but not limited to, streams, other watercourses, lakes, reservoirs, and coastal waters subject to state jurisdiction, and diffused surface water, that is, water occurring upon the surface of the ground other than in contained water bodies. Water from natural springs is surface water when it exits from the spring onto the earth's surface. "Sustainable yield" means the maximum rate at which water may be withdrawn from a water source without impairing the utility or quality of the water source, as determined by the commission and set forth in the plan. "Water management area" means a geographic area which has been designated as such pursuant to section 174C-1, Hawaiʻi Revised Statutes, as requiring management of the ground or surface water resource, or both. "Water meter" means a device installed and owned by the water department that measures the amount of water provided to a consumer. (Ord. 2003 § 1, 1991)
