A.
In those areas where groundwater withdrawal reaches seventy percent of the sustainable
yield, the council shall set forth the allocation of water use, withdrawn or transmitted
or both, through the department's water system for planning purposes.
B.
If the commission designates a water management area pursuant to chapter 174C, Hawaiʻi
Revised Statutes, withdrawals or diversions shall be pursuant to that chapter.
C.
Nothing in this chapter shall be construed to deny the exercise of native Hawaiian
rights, appurtenant rights, riparian or existing correlative uses by the holder thereof
at any time.
D.
Until characteristics such as quantity and quality are established for surface water,
this section shall apply only to the use of potable groundwater.
