This section lists who is allowed to apply for a county grant or loan. It covers the types of organizations and individuals that qualify, and the basic rules they must follow. It also requires applicants to have certain written policies and proper licenses.

An applicant for a grant or loan must: A. Be one of the following: 1. A for-profit organization incorporated under the laws of the State of Hawaiʻi; or 2. A nonprofit organization that: a. Is determined to be exempt from federal income tax by the Internal Revenue Service; and b. Has a governing board whose members have no material conflict of interest and serve without compensation; or 3. A sole proprietor, provided that: a. The application is for a grant administered by the department of agriculture of the County of Maui; and b. The sole proprietor operates in the County at the time of the application. B. Have bylaws or written policies which describe the manner in which business is conducted. The bylaws or written policies must include provisions relating to nepotism and management of potential conflict-of-interest situations. C. Be licensed and accredited in accordance with applicable requirements of federal, state, and county governments, as necessary. The applicant must provide, at a minimum, documentation which shows compliance with all applicable tax requirements. ( Ord. No. 5831 , § 2, 2025; Ord.
