A.
All bids shall be accompanied by a surety bond, a deposit of legal tender or by a
certified check payable to the director of finance drawn on a bank doing business
within the State of Hawaiʻi, for or in a sum not less than five percent of the amount
bid; provided, that when the amount bid exceeds fifty thousand dollars, the deposit
shall be in a sum not less than two thousand five hundred dollars plus two percent
of the amount in excess of fifty thousand dollars. A certified check may be utilized
only to a maximum of forty thousand dollars.
B.
A bid deposit requiring a deposit in excess of forty thousand dollars shall only be
in the form of legal tender or a surety bond conforming to the requirements of section
103-31 of the Hawaiʻi Revised Statutes.
