How a district formation gets started

Proceedings for the establishment of a district may be instituted by the council on
its own initiative.
B.
Proceedings for the establishment of a district shall be instituted by the council
after receipt by the County clerk of a petition requesting the institution of the
proceedings signed by the owners of at least 25 percent of the land in the proposed
district.
The County may also require a fee which the County determines is necessary to compensate
the County, including legal and consultant fees, for the costs of proceedings to form
the proposed district and may enter into a deposit agreement with the owners for such
purpose. The County may also require additional fees as appropriate later in the proceedings.
When required to institute proceedings after the receipt of a petition and any required
fee and deposit agreement, the council shall do so at the first regular meeting for
which notice of a resolution of intention may be posted pursuant to chapter 92, Hawaiʻi
Revised Statutes. Any fee shall be nonrefundable, even if the council does not establish
the proposed district.
