Landowners Can Ask to Skip the Public Hearing

The owners of land proposed to be included in a district may petition for the waiver
of the public hearing required under this article on the establishment of a district.
Waiver petitions shall be submitted in writing to the County clerk. If the owners
of 100 percent of the land proposed to be included in a district submit waiver petitions
at least ten days before the hearing, the council shall not hold the hearing. If a
hearing is not held because of the petitions, the owners shall be deemed to have waived
the right to protest under section 3.75.170 .
