Landowner Protests Can Block a Zoning Change

If owners of more than 55% of the land in a district file written objections before or at a hearing, the objected part of the proposed ordinance cannot be approved. If enough owners withdraw their objections so that 55% or fewer remain, the part can be included. After a blocked provision, no one can try to include it again for one year.

If the owners of more than 55 percent of the land or if more than 55 percent of the owners of the land in the district file written protests with the council before or at the hearing against a provision in the proposed ordinance of consideration and if protests are not withdrawn so as to reduce the amount of the protests to 55 percent or less, the provision specified in the written protests shall not be in the approved ordinance of consideration. No proceedings to include the provision in another ordinance of consideration shall again be undertaken for a period of one year from the close of the hearing. ( Ord. No. 4947 , § 1, 2018)
