Landowner Protests Can Block Early Termination Provision

If more than 55% of landowners in a district file written objections before or at a hearing, the early termination provision in the proposed ordinance cannot be approved. If enough objections are withdrawn to drop below 55%, the provision can stay. After a blocked provision, no one can try to add it again for one year.

If the owners of more than 55 percent of the land or if more than 55 percent of the owners of the land in the district file written protests with the council before or at the hearing against a provision in the proposed ordinance of early termination and if protests are not withdrawn so as to reduce the amount of the protests to 55 percent or less, the provision specified in the written protests shall not be in the approved ordinance of early termination. No proceedings to again include the provision in another ordinance of early termination shall be undertaken for a period of one year from the close of the hearing. ( Ord. No. 4947 , § 1, 2018)
