For the purpose of this chapter, unless it is plainly evident from the context that a different meaning is intended, certain terms and words are defined as follows: "Business" means the offering of goods, wares, food, merchandise of any kind or description, including any other kinds of personal property or services, for sale, lease or rental to consumers. "County property" means any county highway, sidewalk, right-of-way, park, building, community center or other real estate or facility. "Director" means the director of finance of the county of Maui. "H.R.S." means Hawaii revised statutes. "Highway" means the entire width between the boundary lines of every county street when any part thereof is open to the use of the public for purposes of either vehicular or pedestrian travel. "Lunch wagon" means any vehicle from which one sells or offers to sell food and/or beverages, including, but not limited to, motor vehicles, wagons and/or pushcarts. "Municipal parking lot" means those parking lots described in Maui county code, Chapter 10.76 , as amended. "Notification" means either actual notice to the applicant for license or written communication through registered or certified mail, return receipt requested. If service by registered or certified mail is not made because of inability to deliver or refusal by the addressee to accept same, the director may give notice by publishing once in a newspaper of general circulation on the island of Maui. The director shall be entitled to rely on the names and addresses provided by the applicant and it is the applicant's obligation to notify the director of any changes in same. Notification shall be considered given upon evidence of receipt of such letter or completion of publication of such notice as the case may be. "Public parking space" means any space provided to the public for vehicular parking. "Sales representative" or "manufacturers representative" includes persons or business entities who represent manufacturers, wholesalers, or other businesses and whose primary activity is soliciting orders of products to be resold. "School" means any institution conducting educational programs. "School authority" means the chief administrative official of any school, or his or her designee. "Vending" means the carrying on of business as a vendor. "Vendor" means any person, including employees or agents, who engage in business in one locality or traveling from place to place, whether on foot or from a stand, wagon, pushcart, motor vehicle or any other place other than a permanent structure constructed and used in accordance with all applicable county ordinances, including, but not limited to, building, zoning and other land use provisions.
