Vendor license required and how to apply

Before selling goods or services in Maui County, you must get a vendor license. The application must include detailed information about you, your business, vehicles, signs, and locations. The county reviews it, and if they don't decide within a certain time, it's automatically approved.

A. Except as provided herein, every vendor shall, before commencing business in the county of Maui, obtain a vendor's license issued by the director in accordance with this chapter. B. An application shall be in writing, properly verified under oath and filed with the director and shall set forth and include the following information: 1. The name, place of residence, mailing address and telephone number of the applicant; 2. The names and addresses of all corporations, partnerships, associations, person or persons for whom the applicant is acting; 3. The name or trade name, if any, under which the applicant will conduct business; 4. The kind and nature of goods, chattels, property or services to be provided to consumers and customers; 5. A description of the areas, locations or routes to be utilized for the proposed vending activity; 6. A description and the registration number of any vehicle to be used by the vendor; 7. A description of any structure, or other personal property to be used in conjunction with the vending activity; 8. A description, together with plans and specifications, and a drawing showing the size, color, design and wording of any sign proposed to be used in conjunction with the vending activity. All such signs shall comply with the following standards, unless there is a conflict between the provisions of this ordinance and any other ordinance in the County of Maui restricting signage, in which case the more stringent provision shall be applicable: a. Signs shall not exceed eight square feet in area. b. No more than one such sign for each vendor shall be displayed in a manner as to be visible to traffic proceeding on any adjacent street or highway. c. All signs shall be set back not less than fifteen feet from the edge of pavement of any adjacent street or highway. d. Said sign shall not advertise or otherwise contain any reference to any goods, chattels, property or services which are not being provided by the vendor at the location in which the sign is displayed. 9. Any other information which may be required by rules and regulations adopted pursuant to this chapter. C. Review of Application. Within three days (excluding weekends or holidays) upon receipt of an application, the director shall submit a copy of the application to the department of planning for a determination as to compliance with all applicable zoning and land use provisions and to the department of police. Within twenty working days from the receipt thereof, the department of planning and the department of police shall submit to the director a written report together with any recommendations or special conditions which may be necessary or desirable. D. Issuance or Denial of License—Appeal. The director shall issue the license, upon payment of any required fee, with or without such special conditions or requirements as may be appropriate. If the director refuses to issue the license he shall notify the applicant in writing of his decision. Any applicant who is denied a license or who objects to any special conditions or requirements imposed by the director, may within ten working days from receipt of notification, request a hearing before the director. Such hearing shall be held no later than twenty working days after the director has received the request. E. Required Approval. If no action (approval or disapproval) is taken by the director within thirty working days after receipt of a completed application or such longer period as may have been agreed upon in writing, the application shall be deemed approved. It shall be the duty of the director to approve the requested licenses upon payment of the required fee. Such approval by the director shall not exempt the applicant from compliance with the mandatory requirements of this chapter. (Ord. 2603 § 1, 1997; Ord. 1877 § 3 (part), 1990)
