This section explains how to appeal a decision or order from the director. You can file an appeal with the director, who may change the decision only if it was based on a clear factual or legal error, was arbitrary, or was an abuse of discretion.

Any person aggrieved by a decision or order of the director may file an appeal with the director. On appeal, the director may reverse or modify any decision of the director in whole or in part, provided that the director finds that the decision or order was: A. Based on a clearly erroneous finding of material fact or erroneous application of the law; B. Arbitrary and capricious in its application; or C. A clearly unwarranted abuse of discretion. ( Ord.
