This chapter shall not apply to the use of radioactive materials in diagnostic and
therapeutic radiology, biomedical research, educational programs, medical devices
for individual application, agricultural programs, and commercial equipment, processes,
or facilities where such use poses no known public health hazard and is approved by
federal and state licensing and regulatory agencies; provided that all radioactive
waste or abandoned radioactive material resulting from the foregoing exception shall
be transported by the user to a licensed disposal facility outside the state at the
earliest practicable date.
