Which buildings must follow flood rules

This section says the flood rules apply to new buildings, major changes, and some work on existing buildings in flood zones shown on official maps. They also apply to some projects near drainage outside those zones. Some buildings are exempt if they meet other rules or have a flood variance.

The ordinance, as written (Honolulu County) — Applicability

(a) General. The provisions contained herein are applicable to the construction of all new buildings and structures, relocation and major alterations, additions, or reconstruction of existing buildings within the special flood hazard areas as delineated on the flood boundary and floodway maps and flood insurance rate maps, and any amendments by the Federal Emergency Management Agency, on file with the department of planning and permitting, City and County of Honolulu. These provisions shall also apply to developments adjacent to drainage facilities outside the special flood hazard area that are determined to be within a floodway area or a flood fringe area in accordance with Chapter 21A . (b) Nonconforming buildings. Any building or structure that was previously lawful before October 1, 1990*, but that is not in conformity with this article may be continued subject to Chapter 21A . (c) Exemptions. The provisions contained herein shall not apply: (1) To buildings and structures exempted from the special flood hazard area provisions under Chapter 21A ; and (2) To buildings and structures that have been granted a flood hazard variance under provisions of Chapter 21A . ; Sec. 16-5.1, R.O. 1978 (1987 Supp. to 1983 Ed.))
