How to appeal a subdivision decision

If you disagree with a decision made by the director about a subdivision, you can appeal to the zoning board of appeals. You must file your appeal within 15 days of getting the notice, and the board will give you a chance to explain your side. The board can change or cancel the director's decision only if the director made a clear mistake or acted unfairly.

(a) An applicant aggrieved by an action of the director in the administration of the subdivision ordinance or rules and regulations may appeal to the zoning board of appeals within 15 days after receipt of the notice of such action. The applicant shall file three copies of the map and state the grounds for such appeal. The zoning board of appeals shall afford the applicant a reasonable opportunity to be heard. (b) The zoning board of appeals may sustain, modify, or overrule the director’s action; provided that it may modify or overrule the director’s action only if it finds that the director’s action was based on an erroneous finding of a material fact, or that the director had acted in an arbitrary or capricious manner, or had manifestly abused the director’s discretion. )
