City acceptance of streets in approved subdivisions

The city will only accept streets that meet its rules. If a street is built correctly, the city automatically accepts it 30 days after the design department sends a letter. The letter must include a map and a deed.

(a) No street or roadway in any subdivision or consolidation which has not been laid out, improved, and approved in conformity with this article and the subdivision regulations shall be taken over, received by dedication or otherwise accepted as public highways; nor shall any street lighting system or sewer system in a subdivision or consolidation in which such nonconforming streets are located be taken over or accepted. (b) A street or roadway in any subdivision or consolidation which has been laid out, improved, and approved in conformity with this article and the subdivision regulations shall be deemed accepted for dedication by the city council, without further action by the council, 30 days from receipt by the council of a letter from the department of design and construction attesting to that fact. The letter to the council shall be accompanied by a map showing the street and roadway to be dedicated to the city, and a copy of the deed or other document conveying the street or roadway to the city. This subsection shall be repealed if HRS § 264-1(c) is amended to give the council of each county discretion in accepting or rejecting the dedication of streets or roadways that meet county standards. )
