Fines for breaking shoreline rules

If you break shoreline laws, rules, permits, or a variance condition, you can get a civil fine. The first fine can be up to $100,000, and you may owe up to $10,000 each day until you fix the problem or get a variance. Asking for a variance after you've already been caught does not stop the fines.

(a) Any person violating this chapter, any rule adopted pursuant thereto, any permit issued pursuant thereto, or any condition of a shoreline setback variance will, upon notice issued pursuant to § 26-1.14 , be deemed to have committed a civil violation and will be subject to an initial civil fine not to exceed $100,000 per violation and a maximum daily fine of $10,000 until the violation is corrected or a shoreline setback variance is granted. (b) Any order to pay civil fines will not be stayed by the submittal of a shoreline setback variance application after the applicant has initiated, completed, or been cited for the activity.
