Both genders must be on the commission

When an appointing authority chooses members for a commission, it must make sure both men and women are on the commission at all times. If a spot is empty because someone left, that does not count as breaking this rule.

An appointing authority shall make its appointments to the commission so that both genders are represented by the authority’s appointed members at any point in time. This section shall not be deemed violated during any period a gender is not represented among an authority’s appointed members because of a vacancy.
