Temporary replacement for a commission member who cannot serve

If a commission member is sick, unable, or away, the commission tells the person who appointed them. That person can name a temporary replacement until the member returns, their term ends, or 120 days pass. If the member still can't return after 120 days, a different replacement can be named.

(a) When the commission finds that a member cannot serve temporarily because of illness, incapacity, or absence, the commission shall notify the appointing authority for that member. Then, the appointing authority may appoint a temporary replacement to serve until the earliest of the following: (1) The date on which the replaced member resumes service on the commission; (2) The date of expiration of the replaced member’s term on the commission; or (3) The date that is 120 days after the effectiveness of the temporary replacement’s appointment. If the replaced member cannot resume service after the 120th day of subdivision (3), but has an unexpired term remaining, the appointing authority may appoint a different temporary replacement. (b) For the purposes of this section only, council confirmation shall not be required of a temporary replacement for a member who was appointed by the mayor and confirmed by the council.
