Auctioneers must list and tag items before selling

Before an auction, the auctioneer must tag each item with a number and file a sworn inventory with the police chief. The inventory must list each owner's property separately and state that the auctioneer has no interest in the items. A copy must stay at the auction room for anyone to see. Selling untagged or unlisted items is illegal.

(a) Every auctioneer conducting an auction shall, before such sale, mark or tag each article to be offered at such sale with a distinctive number, and shall file with the chief of police an inventory, listing each article and its number. The property of each owner shall be listed separately. The inventory shall contain a sworn statement specifying the ownership of the property to be sold, and an affidavit signed and sworn to by the auctioneer that the auctioneer has no proprietary interest of any nature or degree in the articles listed for sale. A copy of such inventory and statement shall be kept on the premises of the auction room, available for inspection by any person. It is unlawful for any auctioneer to falsify or fail to file such inventory and statement. (b) It is unlawful to sell, offer for sale, or expose for sale at public auction, any property which has not been listed in the inventory required under subsection (a), or any article or property which does not bear a number sufficient to identify it as a part of such inventory. )
