Who is allowed to run an auction

Only a licensed auctioneer can run an auction. The auctioneer can have an assistant run it if the auctioneer is there. If the license is for a company, the company must name a real person as its auctioneer.

It is unlawful for any person, other than the auctioneer who has obtained a license, to conduct an auction; provided that the auctioneer may appoint an agent or assistant who may conduct the auction in the auctioneer’s presence.
