This section explains the meanings of three terms used in this article: minor, spray paint, and toxic chemical substance. A minor is anyone under 18. Spray paint has the same meaning as in another part of the law. A toxic chemical substance is a chemical that can make you intoxicated when inhaled, but it does not include spray paint or wide-tipped markers that are already regulated elsewhere.

For the purposes of this article, the following definitions apply unless the context clearly indicates or requires a different meaning. Minor. Any person below the age of 18 years. Spray Paint. Has the same meaning as defined in § 40-5.1 . Toxic Chemical Substance. Any substance, not a “food” as defined in HRS § 328-1(3), which substance includes in its composition volatile organic solvents including amyl acetate, trichlorethylene, or acetone, or any other chemical substance, capable of producing upon inhalation any degree of intoxication. The term “toxic chemical substance” shall not, however, include any spray paint or wide-tipped marker regulated pursuant to Chapter 40, Article 5 . )
