Fines for retailers who break this law

Retailers who break this law must pay fines. The first time, they pay a base fine plus an extra daily fine until they fix the problem. If they break it again, the fines are higher.

Any retailer found to have violated this article shall be subject to the following, after reasonable notice and an opportunity for a hearing: (1) For the initial violation. (A) The retailer is responsible to pay an administrative fine of $1,000; and (B) The retailer is responsible to pay an administrative fine of $2,000 for each day in which the violation persists beyond the date of the initial violation. (2) For a recurring violation. (A) The retailer is responsible to pay an administrative fine of $2,000; and (B) The retailer is responsible to pay an administrative fine of $5,000 for each day in which the violation persists beyond the date of the recurring violation.
